2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s) ordered electronically by the BUYER via the SELLER's website https://www.madfineviolins.com/, including its specifications and sales price set forth below.

4. GENERAL PROVISIONS

  1. Preliminary Information Confirmation: The BUYER declares, accepts, and undertakes that they have read and informed themselves of the essential characteristics of the product, the total sales price, payment methods, and delivery terms on the https://www.madfineviolins.com/ website, and have provided the necessary confirmation in an electronic environment.

  2. Delivery Period: The product subject to this contract shall be delivered to the BUYER or to the person/organization at the indicated address within the timeframe explained in the preliminary information on the website, provided that it does not exceed the legal 30-day period.

  3. Product Inspection upon Delivery: The BUYER shall inspect the contracted goods/services before accepting delivery. Damaged or defective goods/services (crushed, broken, torn packaging, etc.) must not be received from the courier company. Upon receipt of the goods/services, they shall be deemed undamaged and intact.

  4. Credit Card Security: Payment transactions carried out via credit card are protected using 128-bit SSL encryption protocols. Credit card details are never stored on SELLER systems.

5. RIGHT OF WITHDRAWAL

In distance contracts regarding the sale of goods, the BUYER has the right to withdraw from the contract within 14 (fourteen) days from the delivery date of the product to themselves or the person/organization at the indicated address, without giving any reason and without incurring any legal or criminal liability.

To exercise the right of withdrawal, written notification must be given to the SELLER via e-mail within the 14-day period, and the product must be delivered complete, undamaged, with its original packaging and accessories in accordance with the terms outlined under the Return & Exchange Policy, without impairing its resaleability.

Exceptions to the Right of Withdrawal:

  • Goods produced in accordance with the BUYER’s explicit requests, personal needs, or custom modifications/adaptations.

  • Products whose packaging, tape, seal, or protective elements have been opened after delivery, making their return unsuitable for health or hygiene reasons.

  • Goods that are mixed with other items after delivery and cannot be separated by their nature.

6. DISPUTE RESOLUTION

In the implementation of this Agreement, Consumer Arbitration Committees and Consumer Courts located in the place where the BUYER purchases goods/services or resides are authorized up to the monetary limits determined annually by the Ministry of Commerce.

7. ENFORCEMENT

When the BUYER completes the payment for the order placed through the Website, they shall be deemed to have accepted all terms of this Agreement. The SELLER is responsible for making necessary software arrangements to ensure that the BUYER confirms having read and accepted this agreement prior to order processing.
